Terms of Service

These terms govern your use of barkmarker.com.au (“the site”) and the Bark Marker hire service (“the service”). By using the site or hiring a unit, you agree to them.

The hire service

Bark Marker hires out pre-configured acoustic monitoring units. The current hire fee is $100 per week (inc GST). Delivery within the City of Moreton Bay (MBCC) region is free; for addresses outside that area, postage is a flat $20 (inc GST), which includes return postage. All prices include GST. The specifics of your hire, including duration, payment, and delivery or return arrangements, are confirmed with you when you book.

Return of the unit

The unit remains our property throughout the hire. A refundable $50 deposit is payable on the unit and is returned to you once the unit is received back in working order, less any amount reasonably required for loss of, or damage to, the unit beyond fair wear and tear. You agree to take reasonable care of it, to use it only for its intended purpose, and to return it in working order at the end of the hire period using the arrangements we confirm with you. You are responsible for loss of, or damage to, the unit beyond fair wear and tear while it is in your possession.

Acceptable use and your responsibilities

You agree to use the unit and the site lawfully. In particular:

  • You are responsible for understanding and complying with the laws that apply to recording sound where you live. Recording and surveillance laws vary between states and territories, and it is your responsibility, not ours, to ensure your use of the device is lawful.
  • You are responsible for how you use any recordings, data, or reports the device produces, including how you share them and who you share them with.
  • You must not use the unit to harass, intimidate, or unlawfully surveil any person.
  • You must not attempt to disrupt, damage, or gain unauthorised access to the site or its infrastructure.

Evidence reports and council complaints

The service provides monitoring tools and evidence reports. It does not provide legal advice, and it does not guarantee any particular outcome with a neighbour, a council, or any other body. Councils assess noise complaints under their own local laws and processes, which vary by area. See our disclaimer for more.

Intellectual property

All content on this site, including text, images, and design, is the property of Bark Marker. You may not reproduce or republish it without written permission, except as permitted by Australian copyright law.

Limitation of liability

To the extent permitted by Australian law, Bark Marker is not liable for any loss or damage arising from use of the site, the service, the device, or any report or data it produces, including any outcome of a complaint or dispute. Nothing in these terms excludes, restricts, or modifies any consumer guarantee or right you have under the Australian Consumer Law that cannot lawfully be excluded.

Governing law

These terms are governed by the laws of Queensland, Australia.
